“Online Battle of the Bands” Contest Official Rules
1. FM99 WNOR’s “Online Battle of the Bands”” is an online contest that will occur from 10/24/11 – 11/20/11 (hereinafter referred to as the “contest”) in which 3 local bands will be chosen to play the FM99 Christmas Wish Concert on 12/2/11 at the Jewish Mother in Virginia Beach.
2. How to Enter:
A. This contest is open to all local bands who reside in the FM99 WNOR listening area (Hampton Roads and northeast North Carolina).
B. All band members must be 18 or older to be eligible.
C. One band member will enter on www.fm99.com between 10/24/11 and 11/6/11 at 11:59p by filling out the form. You will be asked to submit a band photo or graphic and a link (URL) to your material. By submitting a photo or graphic, you confirm that you own those images and there are no copyright violations.
D. FM99 reserves the right to reject any URL that contains material deemed inappropriate. All decisions made by FM99 staff and management are final.
E. All links submitted must be a link to an original songs or video. They cannot be cover songs. By submitting a song or video, you are confirming that it is an original song by your band and that you are not in violation of any copyright laws.
F. One entry per band.
G. Winners will be announced and notified on 11/21/11.
H. Bands must be available to play the live at the FM99 Christmas Wish Concert on Friday, 12/2/11(exact time tbd) at the Jewish Mother, 600 Nevan Rd. Virginia Beach, VA.
I. In the event one of the 3 final bands chosen cannot play at the concert, an alternate will be chosen.
J. Bands will not be compensated for their performance. All bands chosen to play must agree to perform for free in the interest of raising money for the FM99 Christmas Wish Fund.
K. Bands chosen to play will be assigned a load-in time and a set time. These times will be decided by FM99 and Jewish Mother staff after voting deadline and the winners have been chosen. All decisions regarding load-in and set times are final.
L. Sound and lights will be provided by the Jewish Mother. Bands are required to provide their own backline.
3. Listener Voting
A. From 11/7/11 through 11/20/11 at 11:59pm, listeners will be asked to go to www.fm99.com and vote for the band they would most like to see play at the FM99 Christmas Wish Concert
B. Each listener may vote for one band one time per day.
C. FM99 and Jewish Mother staff will make the final decision on 11/21/11 as to which 3 bands are chosen to play based upon listener voting and the judge’s opinion of their musicianship and creativity. Alternate bands will also be in chosen in the event one of the three winning bands is unable to perform. The decision of the judges is final.
GENERAL UPICKEM CONTEST RULES
No purchase necessary. One valid entry per contestant.
You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
Winners will be notified by email or phone. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If fm99 cannot find an eligible winner for the prize, that prize will not be awarded.
Odds of winning depend on the number of eligible entries received.
Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.
Only one registered account per voter. If multiple accounts are detected for a single voter, they will be disabled and votes disqualified.
fm99 reserves the right to substitute any prize with another prize of equal or greater value.
fm99 reserves the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of fm99, its respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to fm99 the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
fm99 reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, and/or fm99. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and fm99 are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
fm99 reserves the right to change the rules at any time.
This contest is officially sponsored by fm99.
